Representing national multifamily and mixed-use developers/sponsors in numerous multi-million-dollar development transactions
Represented a Swedish consulting company in connection with its $200 million development of a wood pellet manufacturing plant and harbor warehouse/distribution center for a German utility company. The transaction included customary due diligence, environmental investigations, and contracting issues, including negotiation of documents related to incentives such as tax abatements and grant funds. Also assisted the client with development issues related to other potential sites in Georgia and adjoining states.
Worked with developer on agreements bringing water and sewer service to a planned 1,100 acre mixed-use park for manufacturing, warehousing, distribution, and commercial development in Bryan County, Georgia.
Represented an economic development authority in the acquisition of a 6,000 acre tract of timberland to be developed into an industrial park in Liberty County, Georgia. The representation included all facets of development, including Section 404 permitting, securing the permits to become a designated regional service provider (sewer and water), and resolution of zoning issues.
Comprehensive knowledge of construction legal issues: Our attorneys routinely represent clients in construction disputes including differing site condition claims, delay issues, lien claims, private bond claims, and public bond claims under the Federal Miller Act and the State of Georgia’s Little Miller Act.
Represented a developer in the new construction of a 108-unit multifamily rental housing project located in Atlanta, Georgia. Financing included a $7,032,700 FHA Insured 221(d)(4) loan, subordinate financing, and state and federal low-income housing tax credits. The project closed in May 2019.
Represented parties in various types of leasing transactions, including ground lease developments, retail leasing, office leasing, industrial leasing, and warehouse leasing.
Representation of a master developer in all facets of a mixed-use master development agreement with a housing authority, resulting in three phases of affordable multifamily rental housing, the subdivision and sale of a residential lot to a luxury apartment builder, the subdivision and sale of single-family residential lots to a national single-family builder, and the subdivision and sale of commercial lots to a retail developer.
